The Adult Survivors Act (the “ASA”) is a landmark new law that re-opens the statute of limitations for sexual abuse claims in New York, even if the victim was an adult at the time of the abuse. The ASA establishes a one-year look-back window.

The ASA is modeled on the Child Victims Act (the “CVA”), which created a look-back window for survivors of sexual assault who were under the age of 18 at the time of the assault. The CVA resulted in over eight thousand lawsuits and has been incredibly effective at holding institutions accountable for long-ago abuse of children.

The CVA only applied to cases of abuse where the victim was under eighteen years of age at the time of the abuse. The newly-enacted ASA creates a similar one-year look-back window for survivors of sexual abuse who were over eighteen years old at the time of abuse and whose claims are presently time barred.

NYC’s Victims of Gender-Motivated Violence Protection Act establishes a two-year look-back window.

A two-year look-back window opened on March 1, 2023 for sexual assault that qualifies under New York City’s Victims of Gender-Motivated Violence Protection Act. This law may provide an additional avenue to pursue your claim.

Prior to his death in July 2019, Jeffrey Epstein used his position as a wealthy and powerful individual to prey upon and sexually abuse hundreds and possibly thousands of girls and women.  Epstein frequently lured girls and women into his orbit by holding out the prospect of modeling jobs or paying for their education and using his immense wealth, power and proximity to fame to better their circumstances.  Epstein often groomed these girls or young women by making them highly dependent on him. Other times, he lured them in just once to give him a “massage” and treated them like objects, less than human.   Over and over, he coerced these girls and women to perform involuntary sexual acts, ranging from unwanted sexual touching to rape.  Epstein engaged in this horrific pattern of behavior for decades, causing severe and permanent emotional harm to the women he abused.

A confidential program has been approved by a court that allows survivors of Jeffrey Epstein’s abuse to finally have the opportunity to present their claims to neutral, independent administrators to seek monetary compensation from Epstein’s Estate, which is worth over half a billion dollars.  Any individual who was sexually abused by Epstein will be eligible to participate in the confidential program, even if they were abused in another non-US country, or if their legal claims appear to be barred because of the amount of time that has passed or even if they entered into a prior settlement with Jeffrey Epstein.
