John R. Cuti is a seasoned trial lawyer and problem solver. His litigation experience includes high-profile First Amendment, white collar criminal, and securities fraud matters, including class actions. Prior to founding Cuti Hecker Wang LLP, John R. Cuti was a partner at Davis Wright Tremaine and Emery Cuti Brinckerhoff & Abady. He also served as the General Counsel to two public companies, Martha Stewart Living Omnimedia, Inc. and MortgageIT Holdings, Inc.

Obtained reversal of murder conviction in the Appellate Division, Fourth Department; currently representing defendant in retrial.

Gregory Barton v. Martha Stewart Living Omnimedia, Inc.
Successfully defended public company against claim by former executive for benefits under an ERISA plan in matter before the United States District Court for the Southern District of New York. Read decision.

Estate of Kurt Doerbecker et al. v. Nassau County et al.
Successfully represented estate and family of 23-year old man who was fatally shot in the back of the head by a Nassau County police officer in a federal civil rights and wrongful death suit.

Luke Herrine and Leo Gertner
Successfully represented two law students at NYU School of Law in motion to quash non-party subpoenas on First Amendment grounds in civil RICO action.

Confidential DOJ Investigation
Represents senior financial services executive in connection with DOJ inquiry into trading practices at large financial institution.

Represented two parties served with subpoenas by the Moreland Commission, an investigative body created by Governor Cuomo to investigate lobbying and ethical issues in State government.

Represented criminal defendant accused of defrauding and stealing from his mother, Brooke Astor, including serving as trial counsel and lead appellate counsel and assisting in Ambassador Marshall's successful application for medical parole.

Brodsky v. Match.com
Successfully represented Match.com in a putative nationwide class action alleging RICO, consumer fraud, and contract violations stemming from an alleged failure to disclose limitations on communications between subscribers and members. Read decision.

Third Church of Christ, Scientist v. City of New York
Obtained a permanent injunction under the Religious Land Use and Institutionalized Persons Act against the New York City Department of Buildings relating to the revocation of permits to renovate a church. Read decision.

Matter of Merrill Lynch
Represented a Merrill Lynch senior executive in connection with an inquiry by the New York Attorney General regarding executive compensation and other matters.

In re Martha Stewart Living Omnimedia Securities Litigation
Managed the mediation and settlement of a $30 million securities fraud class action.

United States v. Martha Stewart and Peter Bacanovic
Served as trial counsel for Martha Stewart in a criminal trial alleging securities fraud and obstruction of an SEC agency proceeding.

NYRealty LLC v. MortgageIT, Inc.
Successfully defended client against claims for $260 million for alleged breaches of contract and fiduciary duty.

Friends of the HighLine v. City of New York
Won a preliminary injunction on behalf of the New York City Council preventing the destruction of an elevated railroad line that has since been converted into a unique public park.

Jacobs v. Seminole County Canvassing Board
Served as trial counsel in a challenge to the Seminole County absentee ballot application process as part of the statewide Democratic Party challenge to the 2000 presidential election in Florida.

McCain v. Powers; Rockefeller v. Powers
